Terms of Service

1. Agreement

By accessing or using sylunara ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. The Platform is operated by sylunara and its affiliates.

2. Eligibility

You must be at least 18 years old to use the Platform. By creating an account, you represent that you meet this requirement and that the information you provide is accurate.

3. Account & Access

Access is invite-only. You are responsible for maintaining the security of your account credentials. You may not share, sell, or transfer your account or invite access to others without authorization.

4. Subscription & Billing

• The Platform offers a subscription at $20/month (USD) or as otherwise stated at the time of purchase.
• Billing is recurring. You authorize us to charge your payment method on each billing cycle.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.
• Prices may change with 30 days' notice.

5. What You Get

Your subscription includes access to:

• AI inference powered by Llama 3.1 (Meta, open license) and Claude (Anthropic)
• Persistent memory and time capsule features
• Hive mind network access
• Community features and platform updates

We reserve the right to modify features, add capabilities, or adjust usage limits as the platform evolves.

6. Your Data & Sovereignty

• You own your data. Conversations, capsules, memory, and any content you create belong to you.
• We do not sell, license, or share your data with third parties for advertising or profiling purposes.
• We store data necessary to provide the service (memory, capsules, account info). You may request deletion at any time.
• Anonymized, aggregate usage data may be used to improve the platform.

7. Acceptable Use

You agree not to:

• Use the Platform to generate content that is illegal, harmful, or violates the rights of others
• Attempt to reverse-engineer, exploit, or compromise the Platform's infrastructure
• Abuse API access, rate limits, or inference resources
• Impersonate others or misrepresent your identity
• Resell access or redistribute Platform outputs commercially without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

8. AI & Inference

• The Platform uses open-source models (Meta Llama 3.1, licensed under the Meta Llama 3.1 Community License) and third-party APIs (Anthropic Claude).
• AI outputs are generated content and should not be treated as professional, legal, medical, or financial advice.
• You are responsible for how you use AI-generated outputs.
• We do not guarantee the accuracy, completeness, or reliability of any AI output.

9. Intellectual Property

• The Platform, its design, code, and brand are the property of sylunara.
• Content you create using the Platform is yours.
• You grant us a limited license to process and store your content solely to provide the service.

10. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, sylunara shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

11. Termination

Either party may terminate at any time. Upon termination, you may request export of your data within 30 days. After that period, data may be permanently deleted.

12. Changes

We may update these terms. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.
